TERMS OF SALE

1. OBJECT

1.1. These General Conditions of Online Sale (hereinafter "GCS") govern the contract (hereinafter "AGREEMENT") for the sale of clothing and accessories products marked exclusively by the NOSCHESE DANCING brand (hereinafter "PRODUCTS") produced by No .Sa.R. Production srl - with headquarters in Via Irno snc, 84098 Pontecagnano Faiano (SA), VAT number 04986150656 (hereinafter "NO.SA.R. PRODUCTION SRL") - through its website www.noschesedancing.com (hereinafter " SITE ") to users of the SITE (hereinafter" CUSTOMER "or" CUSTOMERS ").

1.2. On the SITE, the section "Customer Service" contains important information, useful for an informed and informed purchase by the CUSTOMER.

1.3. In these GCS, the term CUSTOMER or CUSTOMERS means the "consumer" or "consumers" as per article 3, co. 1, lett. a), of Legislative Decree 6 September 2005, n. 206 (hereinafter "CODE"), that is the natural person who acts for purposes unrelated to any business or professional activity carried out.

2. EFFECTIVENESS AND MODIFICATION OF THE GCS

2.1. The GCS are available on the SITE to be easily read by the CUSTOMER before registration and before making the purchase of the PRODUCTS; are intended together with the registration and submission of the purchase order form, and can be stored on the CUSTOMER's computer and reproducible on paper by printing the file in which they are contained.

2.2. The GCS applicable to the sale of the PRODUCTS are those published on the SITE, on the date of the order relating to the PRODUCTS. The CUSTOMER, therefore, must view the GCS, every time he intends to make a purchase on the SITE. 

2.3. The mere tolerance or failure to contest by NO.SA.R. PRODUCTION SRL of any breaches by the CUSTOMER with respect to what is contained in the GCS cannot be interpreted as a tacit acceptance of such breaches, nor as a desire to derogate from what was agreed between the parties.

3. REGISTRATION AND PURCHASE PROCEDURE

3.1. he CUSTOMER who intends to proceed with the purchase of the PRODUCTS must manifest this will by registering his / her data and a request made directly on the SITE where, following the purchase procedure indicated therein, he / she will forward his electronic order electronically purchase (hereinafter "ORDER") and the related payment, except as specifically regulated in article 7.4.

3.2. The order form contains a reference to the GCS and a summary of the information on the essential characteristics of each product ordered and the relative price (including all applicable taxes and duties), the chosen means of payment, the delivery methods of the products purchased , shipping and delivery costs: before sending the ORDER, the CUSTOMER must carefully read the entire content, identify and correct any errors in data entry.

3.3. The CUSTOMER can access his order form, by consulting the "ORDER HISTORY" section within "MY ACCOUNT" and in the event that he wishes to proceed with the cancellation of the ORDER or modification of the ORDER by increasing, decreasing the quantities of the PRODUCTS previously ordered, or simply modifying, inserting new articles in addition or in replacement of the PRODUCTS themselves, must necessarily send an e-mail to info@noschesedancing.com provided that the relative shipment has not already been confirmed by NO.SA.R PRODUCTION SRL with shipment confirmation e-mail (hereinafter "SHIPMENT CONFIRMATION") referred to in article 3.5 below.

3.4. Once the ORDER is received, NO.SA.R. PRODUCTION SRL will send the CUSTOMER an order confirmation e-mail (hereinafter "ORDER CONFIRMATION"), containing a summary of the content of the information relating to the sale, and will proceed with the fulfillment of the ORDER, except as provided next article 3.6.

3.5. All purchase orders for the PRODUCTS are subject to their availability and, therefore, to the confirmation of NO.SA.R. PRODUCTION SRL, which will communicate this availability by sending an e-mail to the SHIPPING CONFIRMATION CUSTOMER.

3.6. In case of non-execution of the ORDER, due to unavailability of one of the ordered PRODUCTS, NO.SA.R. PRODUCTION SRL will inform the CUSTOMER by e-mail and ask for confirmation of the CUSTOMER ORDER, for the purchase of the remaining available PRODUCTS. In any case, the unavailability of one or more of the ordered PRODUCTS will not automatically give the CUSTOMER the right to cancel the entire ORDER.

3.7. The CONTRACT between the CUSTOMER and NO.SA.R. PRODUCTION SRL is regulated by the ORDER, the SHIPPING CONFIRMATION as well as the GCS and the Privacy Policy (hereinafter "PRIVACY") both published on the SITE.

4. RIGHTS AND OBLIGATIONS OF NO.SA.R. PRODUCTION SRL

4.1. NO.SA.R. PRODUCTION SRL, undertakes to deliver the PRODUCTS to the address and within the terms indicated by the CUSTOMER in the ORDER. NO.SA.R. PRODUCTION SRL will not be responsible for delivery errors due to inaccuracies or incompleteness in completing the ORDER or for unavailability of the CUSTOMER himself. Delivery cannot be made to PO boxes.

4.2. In case of return, in whole or in part, of the PRODUCTS by virtue of the right of withdrawal or the guarantee due by law, NO.SA.R. PRODUCTION SRL, in accordance with the provisions of the following articles 9 and 10, will exchange and replace the products, since there will be no refund of the corresponding amounts.

5. RIGHTS AND OBLIGATIONS OF THE CUSTOMER

5.1. The CUSTOMER is solely responsible for the veracity of the data and the correctness of the information provided to NO.SA.R. PRODUCTION SRL during registration through the SITE and undertakes to promptly communicate any changes in the data entered.

5.2. When registering and sending the ORDER, the CUSTOMER declares to have read, understood and accepted the GCS and the further information contained in the SITE, in particular in the "Customer Service" section, including the PRIVACY; to be an adult, with the legal capacity to act.

5.3. Once the purchase procedure has been completed on the SITE, the CUSTOMER undertakes to save both an electronic copy and print the ORDER and the GCS for the purpose of their conservation, as indicated in the previous article 2.1.

6. USE OF THE SITE

6.1. The essential characteristics of the PRODUCTS are presented on the SITE within each product sheet. The images and colors of the products offered for sale on the SITE may not correspond perfectly to the real ones, since computer screens vary. Therefore NO.SA.R. PRODUCTION SRL cannot guarantee that the color displayed on the CUSTOMER's monitor perfectly matches the actual color of the PRODUCTS.

6.2. NO.SA.R. PRODUCTION SRL assumes no responsibility for the problems caused to the CUSTOMER by the use of the SITE and the technologies used as they are not dependent on its own will, such as, for example: a) errors, delays or impossibility of access to the SITE by of the CUSTOMER on the occasion of the execution of the sales procedure; b) errors, delays or impossibility in the receipt by the CUSTOMER of the communications made by NO.SA.R. PRODUCTION SRL in relation to the sale of the PRODUCTS.

6.3. In any case, NO.SA.R. PRODUCTION SRL through its Customer Service, undertakes, as far as possible, to solve the problems that may occur and to offer the necessary assistance to the CUSTOMER to obtain a quick and satisfactory solution to the aforementioned problems.

7. PRICES AND PAYMENTS

7.1. The prices of the PRODUCTS are those actually displayed on the WEBSITE at the time the ORDER is issued and, unless otherwise specified, are inclusive of VAT. The shipping and delivery costs of each of the PRODUCTS must be added to the prices shown on the SITE, which will be duly highlighted and summarized before the ORDER is issued and subsequently also in the ORDER CONFIRMATION.

7.2. The total price for the purchase of the PRODUCTS and the shipping and delivery costs, as indicated in the ORDER, will be charged to the CUSTOMER only at the time of shipment of the PRODUCTS, after sending the SHIPMENT CONFIRMATION.

7.3. Payment can be made by credit card, Paypal, bank transfer and any other.

8. DELIVERY OF PRODUCTS TO THE CUSTOMER

8.1. Upon delivery of the PRODUCTS to the CUSTOMER by the courier in charge of their transport, the CUSTOMER must check: a) that the quantity and type of PRODUCTS ordered corresponds to what is indicated in the transport document; b) that the packaging used for transport is intact, not damaged, wet or in any way altered, even only in the sealing materials.

8.2. Any anomalies must be immediately reported to the courier upon receipt of the PRODUCTS, by indicating them on the delivery note. The CUSTOMER in order to facilitate and speed up the procedure for checking any anomalies by NO.SA.R. PRODUCTION SRL, you can write an e-mail to info@noschesedancing.com.

9. RIGHT OF WITHDRAWAL

9.1. The CUSTOMER has the right to withdraw from the contract concluded with NO.SA.R. PRODUCTION SRL, within 10 (ten) working days from the delivery date of the PRODUCTS, provided that the return procedure referred to in this article is respected and that the products to be returned (hereinafter "RETURNED PRODUCTS") are intact, never worn , complete with its own packaging, original tags and labels as better regulated in the following article 11.

9.2. In case of exercise of the right of withdrawal, even partial, the only costs borne by the CUSTOMER will be those for returning the RETURNED PRODUCTS which must be made in a single solution.

9.3. The shipment must be made from the country from which the order was made and addressed to: No.Sa.R. Production srl - NOSCHESE DANCING, Via Irno snc, 84098 Pontecagnano Faiano - Salerno (Italy). The address of NO.SA.R.

9.4. Furthermore, the right of withdrawal is understood to be exercised correctly if the CUSTOMER respects the following obligations:

1) send, within 10 (ten) working days from the delivery of the PRODUCTS, an e-mail of notification to the address info@noschesedancing.com specifying in the text of the e-mail the order number, the numerical code of the product or of the RETURNED PRODUCTS, the quantities and the reason for the return;

2) prepare the package using the original packaging or, if this is not possible, in a package of equivalent size and resistance and close carefully with scotch tape, print the return label contained in the return authorization email, which you will have received from NO.SA.R. PRODUCTION SRL, and stick it on the box in order to cover the information of the first shipment;

choose a courier at will to send to NO.SA.R. PRODUCTION SRL RETURNED PRODUCTS, no later than 14 (fourteen) working days from receipt of the return authorization e-mail. The CUSTOMER must personally pay the costs of returning the RETURNED PRODUCTS against him. In this case, the CUSTOMER will be liable for any loss or damage to the PRODUCTS RETURNED during transport.

9.5. If the right of withdrawal is exercised following the methods and terms indicated in this article NO.SA.R. PRODUCTION SRL will reimburse the CUSTOMER any sums already collected for the purchase of RETURNED PRODUCTS according to the methods and terms established and in any case, within 14 (fourteen) days from the day on which NO.SA.R. PRODUCTION SRL is informed of the consumer's decision to withdraw. NO.SA.R. PRODUCTION SRL will be able to withhold the refund until it has received the RETURNED PRODUCTS.

9.6. If the methods and terms for exercising the right of withdrawal, as specified in this article, are not respected, the CUSTOMER will not be entitled to a refund of the sums already paid to NO.SA.R. PRODUCTION SRL. However, you may get back, at your expense, the PRODUCTS RETURNED in the state in which they were returned to NO.SA.R. PRODUCTION SRL. Otherwise, NO.SA.R. PRODUCTION SRL may retain RETURNED PRODUCTS, in addition to the amounts already paid for their purchase.

9.7. In the event of a refund, the CUSTOMER will still need a bank or postal or Paypal account.

10. RETURNS FOR DEFECTS OR PRODUCT DIFFORMITIES

10.1. NO.SA.R. Before shipment to the CUSTOMER, PRODUCTION SRL submits all PRODUCTS to an accurate quality control and to any defects.

10.2. In any case, NO.SA.R. PRODUCTION SRL will provide, in relation to the PRODUCTS purchased by the CUSTOMER, the legal guarantee of compliance with the conditions and terms established by law. In particular, the rights deriving from this guarantee may be exercised on condition that the PRODUCTS have been used correctly, with due diligence and in compliance with the intended use and as provided in the indications enclosed and returned in accordance with the provisions of this article and subsequent article 11.

10.3. In the case of defective or different products from those ordered (hereinafter "DEFECTIVE PRODUCTS"), the CUSTOMER, without exception, must:

1) firstly send an e-mail to NO.SA.R. PRODUCTION SRL, at info@noschesedancing.com  specifying in the text of the e-mail the order number, the numeric code of the product or products to be returned, the quantities and the reason for the return;

2) prepare the package using the original packaging or, if this is not possible, in an equivalent size and resistance package and close carefully with scotch tape, print the label with the return shipping address written on it, which you will have received from NO .SA.R. PRODUCTION SRL, and stick it on the box in order to cover the information of the first shipment; 

3) arrange for shipping by courier chosen by the customer. Sending DEFECTIVE PRODUCTS to NO.SA.R. PRODUCTION SRL, must take place no later than 10 (ten) working days from the receipt of the return authorization e-mail.

10.4. If the return for DEFECTIVE PRODUCTS is exercised following the methods and terms indicated in this article, NO.SA.R. PRODUCTION SRL will, at its expense, replace or exchange the products within 30 (thirty) days from the date of receipt of the DEFECTIVE PRODUCTS.

11. PRODUCT INTEGRITY

All PRODUCTS are equipped with an identification tag, internal labels and their own packaging. NO.SA.R. PRODUCTION SRL, in case of exercise of the CUSTOMER's right of withdrawal, has the right not to accept the return of the RETURNED PRODUCTS that have been used, worn, washed, damaged or altered in their essential and qualitative characteristics and / or that do not have the relative tag, internal labels, any other material that is part of the original packaging. In case of return of spoiled products, NO.SA.R. PRODUCTION SRL will not consider defective products damaged due to wear and tear.

12. PROTCTION OF PERSONAL DATA

12.1. NO.SA.R. PRODUCTION SRL guarantees the CUSTOMER that the personal data acquired in relation to the sale of the PRODUCTS will always be processed in a lawful and correct manner, in full compliance with the provisions of Legislative Decree no. 30 June 2003, n. 196 (hereinafter "DECREE") in accordance with the contents of the PRIVACY, published on the SITE and printable.

12.2. For any information relating to the processing of personal data, please refer to the information on data processing made by NO.SA.R. PRODUCTION SRL, pursuant to article 13 of the DECREE, to the CUSTOMER when registering on the SITE. We remind you that the CUSTOMER, in case of need for further clarifications regarding the processing of personal data (article 7 of the DECREE) may contact NO.SA.R. 13. COMMUNICATIONS

For any need for assistance or complaint relating to the PRODUCTS purchased, the CUSTOMER may contact NO.SA.R. PRODUCTION SRL at the following e-mail address: info@noschesedancing.com.

14. APPLICABLE LAW AND JURISDICTION

14.1. The GCS are regulated by Italian law and in particular by the CODE and by the legislative decree 9 April 2003 n. 70 relating to some peculiarities of electronic commerce.

14.2. For any dispute that may arise regarding the validity, interpretation, execution, resolution of these GCS and / or individual purchase orders, the Court of Rimini (Italy) will be exclusively competent and without competing forums and total mutual renunciation of any other forum.
